Income Tax 2016-17 – All Salaried Employees to declare deductions and savings under Form 12BB

The Finance Act, 2015 had introduced section 192(2D) of the Income-tax Act, 1961 (the Act) wherein the person responsible for making payment of salary (employer) was obliged to collect the necessary evidence or proof in the prescribed form and manner to allow any claim for any deduction and/or tax saving investments. However, the relevant rules and form were yet to be prescribed. The Central Board of Direct Taxes (CBDT) has come out with the relevant rules1 and also prescribed the form i.e. Form 12BB, in which salaried employees would now be required to furnish evidence of claims and tax saving investments to the employer.

Income Tax 2016-17 – Deductions and Exemptions allowed for Salaried Employees

Till Finance Act 2016, there was no standard format for salaried employees for filing declaration with their employer to claim deduction for savings under Section 80 C, payment of house loan interest under Section 24, and HRA exemption under Section 10. In the absense of single declaration form, employees had to submit proof for each investment made in the year.
As a relief to employees and also to employer, Income Tax Department has introduced a new Form 12BB. This form, applicable from June 1, 2016, will act as a single entity that you can use to declare your to claim deduction for savings under Section 80 C, payment of house loan interest under Section 24, and HRA exemption under Section 10.

Deductions that can be declared under Form 12BB:

The standard Form 12BB is for all salaried Employees to claim tax deductions. You use can use it to claim deductions for leave travel allowance (LTA/LTC), house rent allowance (HRA), interest paid on home loans, and all other tax deductions pertaining to Chapter VI-A of the Income Tax Act.

House Rent Allowance (HRA):

With form 12BB, you can claim any HRA tax deductions under Section 10 (13A) of the Income Tax Act. Along with 12BB you will need to provide the relevant rent receipts for this deduction. You will also need to submit the name and address of the landlord. In the event the aggregate rent paid by you exceeds Rs 1 lakh, you will also need to submit the Permanent Account Number (PAN) of your landlord.

Amount claimed under Leave travel Concession (LTC)

With Form 12BB, you need to furnish amount and provide evidence of expenses made towards your travel. Unlike in the past, it is now mandatory to provide proof of all travel expenses in the form of receipts for your claim.

Interest on home loan under Section 24:

Earlier to claim deduction for interest paid on home loan, we have to submit interest certificate from the concerned bank. Now, in addtion to the same we will have to fill up Form 12BB to claim deductions under Section 24 of the Income Tax Act.

Savings / deductions under Chapter VI-A:

All tax deductions under Section 80C, Section 80CCC, and Section 80CCD, as well as other sections like 80E, 80G, and 80TTA come under Chapter VI-A of the IT Act. For deductions, fill up Form 12BB and provide details and proof of your investments and expenditures incurred related to the relevant section you are seeking deductions under.

The CG Staff are not yet given the full Benefit of 7th CPC Recommendation

The recommendation of 7th Pay Commission has been implemented with effect from 1.1.2016 and the revised salary is being paid from this effective date. The Central Government, after implementing the Pay Panel report, hasn’t announce any decision about Allowances even after 12 months, created frustration among central government employees.

The Pay Commission is constituted once in Ten Years to revise the Pay and Allowances and Pension for Govt Servants and Pensioners. Accordingly, the 7th Pay Commission was formed and it submitted its report to the Government on 19-11-2015. The Government Accepted the Report without any major changes and announced on 29.6.2016 that it would be implemented with effect from 1.1.2016.

Since the increase in salary which is paid from 1.1.2016 was very less, it has demolished the expectations of CG Staffs.

Very important aspect in revising Pay and Allowance is House Rent Allowance. The rates of HRA is determined based on the Population of the Cities in which the Govt Servants are working. Accordingly, 10,20 and 30% of Basic Pay is paid as HRA in Sixth CPC. The 7th CPC has recommended to revise it as 8%, 16% and 24%.
Interceptor missile successfully test-fired

India today successfully test-fired its interceptor missile off the Odisha coast, achieving a significant milestone in the direction of developing a two-layered Ballistic Missile Defence system.
The interceptor was launched from Abdul Kalam Island (Wheeler Island) of ITR at about 7.45 AM.
This mission, termed as “PDV mission is for engaging the targets in the exo-atmosphere region at an altitude above 50 km of earth’s atmosphere”, said a Defence Research Development Organisation (DRDO) official.
“Both, the PDV interceptor and the two stage target missile, were successfully engaged,” he said.
The target was developed for mimicking a hostile Ballistic Missile approaching from more than 2000 km away was launched from a ship anchored in the Bay of Bengal.
In an automated operation, radar based detection and tracking system detected and tracked the enemy’s ballistic missile.
The computer network with the help of data received from radars predicted the trajectory of the incoming Ballistic Missile.
PDV that was kept fully ready, took-off once the computer system gave the necessary command for lift-off. The Interceptor guided by high accuracy Inertial Navigation System (INS) supported by a Redundant Micro Navigation System moved towards the estimated point of the interception.
Once the missile crossed the atmosphere, the Heat Shield ejected and the IR Seeker dome opened to look at the Target location as designated by the Mission Computer.
With the help of Inertial Guidance and IR Seeker the missile moved for interception. All events were monitored in real-time by the Telemetry/Range Stations, at various other locations.

The Ministry of External Affairs (MEA) and the Department of Posts (DOP) announced on 24 January, 2017 their decision to utilize the Head Post Offices (HPO) in the various States as Post Office Passport Seva Kendra (POPSK) for delivering passport related services to the citizens of our country. The POPSK at these two places have been running successfully since their inauguration. One hundred appointments are being released every day for each of these POPSK.

With the successful operationalization of these two pilot projects, the Government has now decided to scale up this programme by opening 56 POPSKs at the following places in the first batch of expansion:

MEA and DOP are working closely for the early commencement of passport related services at the above mentioned POPSK. Once fully functional, applicants who apply for their passports on-line through the Passport Portal will be able to schedule an appointment at the above POPSK to complete the formalities necessary prior to the issue of the passport.

Following the liberalization of passport policies announced on 23 December, 2016, we have seen nearly 30% surge in demand for passports. For example, a record number of 53,400 applications were processed on 7.2.2017 out of which 49,259 were fresh applications. This is the highest since the commencement of the Passport Seva Project. Our Passport Offices are conducting special Passport Melas during the weekends to cater to the increasing demand for passports.

The pilot projects of the Post Office Passport Seva Kendras (POPSK) have been running successfully at Mysuru and Dahod. We have been releasing 100 appointments for Mysuru and Dahod POPSK per day with cent per cent utilization. Appointments for Mysuru are now available in ten days while at Dahod it is available the next day.

These are clear indicators that the liberalization of the passport policies and opening of the POPSK have been successful efforts of the Government that have been welcomed by our citizens. We expect that opening of these additional POPSK would further help our citizens in getting passports easily.
